Trademark Tussle in Nigeria’s Beverage Sector: Rite Foods Challenges Mamuda Beverages Over Pop Power Energy Drink

In a significant legal development within Nigeria's beverage industry, Rite Foods Limited, renowned for its Fearless Energy Drinks, Bigi soft drinks, and Sosa fruit beverages, has initiated a trademark infringement lawsuit against Mamuda Beverages Nigeria Limited, the producers of Pop Power Energy Drink.

The case, filed at the Federal High Court in Abuja under suit number FHC/ABJ/CS/705/2025, centers on allegations that Mamuda Beverages' Pop Power Energy Drink bears a striking resemblance to Rite Foods' Fearless Energy Drink, potentially leading to consumer confusion and brand dilution.

Rite Foods contends that the design elements, color schemes, and overall branding of Pop Power closely mimic those of Fearless, which has been a staple in the Nigerian energy drink market since its launch in 2017. The company argues that such similarities infringe upon its established trademarks and could mislead consumers regarding the origin of the products.

In response, Mamuda Beverages, through its legal representative O.E.B. Offiong, has filed a preliminary objection, asserting that the lawsuit constitutes an abuse of court process. The defense emphasizes the need to address jurisdictional issues before delving into the substantive matters of the case.

This legal confrontation is not Rite Foods' first foray into trademark disputes. In 2021, the company engaged in a legal battle with the Nigerian Bottling Company (NBC) over the alleged infringement of its Fearless Energy Drink trademark by NBC's Predator Energy Drink. The dispute centered on similarities in branding elements, particularly the use of a lion head symbol, which Rite Foods claimed could cause consumer confusion. However, the court eventually set aside the contempt proceedings initiated by Rite Foods, highlighting the complexities inherent in trademark litigation within the beverage sector.

The current case underscores the growing importance of intellectual property rights enforcement in Nigeria's competitive beverage industry. As brands vie for market dominance, the protection of distinctive trademarks becomes paramount to maintaining brand identity and consumer trust.

The outcome of this lawsuit could set a precedent for future trademark disputes in the Nigerian market, emphasizing the need for companies to establish clear and distinctive branding to avoid potential legal entanglements.
